1.  Minimum Wage Implementation.

The government has announced through various media that the Minimum Wage for all employees will be increased to RM1,500.00 effective 1 May 2022. Please refer to the Federal Government Gazzette for the detailed mechanism.

1.1. Employers with less than 5 Employees 
       Effective Date: 1 May 2022 to 31 December 2022


Effective Date: 1 January 2023


1.2. Employers with 5 or more Employees
       Effective Date:  1 May 2022

*  This is regardless of the number of employees employed, an employer who carries out a professional activity classified under the Malaysia Standard Classification of Occupations (MASCO) as published officially by the Ministry of Human Resources.

Employers can make the necessary changes in FlexHR System as per the steps provided in FlexHR Help Center link below:

i. Login to FlexHR Help Center
ii. Enter “minimum wage 2022” and click search
iii. Select the guideline base on your flexHR version.

2.  Paternity Leave Increase. (Pending Gazette)
The Employment Act 1955 (Act 265) was tabled and approved at the Dewan Rakyat sitting on 21 March 2022 (Monday). Employees will be able to have seven days of paternity leave instead of 3 days in the future but with some eligibility criteria.

3.  Maternity Leave Increase. (Pending Gazette)
Employees can also expect to have an increase in maternity leave from 60 days to 98 days, which is in line with the International Labour Organisation Convention as tabled and approved at the Dewan Rakyat.
